Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of services provided by Dollar Web Design Co LLC, operating as Punch ("Company," "we," "us," or "our"). By accessing our website at throwpunch.com or purchasing any of our services, you agree to be bound by these Terms.

2. Services

Punch provides growth strategy consulting, custom technology development, RevOps infrastructure, and related services on a subscription and one-time basis. The specific scope of services is defined at the time of purchase or engagement.

3. Subscriptions

Subscription services are billed on a monthly basis. You may pause or cancel your subscription at any time. Pausing is available for up to 60 days per calendar year. Cancellations take effect at the end of the current billing period. We do not offer prorated refunds for partial months.

4. Refund Policy

For subscription services, we do not offer refunds for completed billing periods. For one-time services, refunds may be issued at our discretion within 7 days of purchase if no work has commenced. Once work has begun on a project, no refunds will be issued. If you are dissatisfied with our services, please contact us at hello@throwpunch.com and we will work to resolve the issue.

5. Intellectual Property

Upon full payment, all custom work product created specifically for your engagement becomes your property. We retain the right to showcase general concepts and approaches (without disclosing proprietary business information) in our portfolio. Pre-existing tools, frameworks, and methodologies we use remain our property.

6. Confidentiality

We treat all client information as confidential and will not disclose your proprietary business information to third parties without your consent, except as required by law.

7. Limitation of Liability

To the maximum extent permitted by law, Punch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising from our services shall not exceed the amount paid by you in the three months preceding the claim.

8. Governing Law

These Terms shall be governed by the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Greene County, Missouri.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify active subscribers of material changes via email. Continued use of our services after changes constitutes acceptance of the new Terms.
